Solana ($SOL) NFT artist John Lê has been scrutinized by some of the Solana NFT community on Twitter for his one-on-one artwork titled “Chosen.” The reason is that he sells a printed version of this, even though he has previously stated that this work is 1:1. This is not illegal, but it is certainly bad ethics. The sentiment from the community is that the original works lose value due to these new prints.
What’s happening with the “chosen piece”
The first piece, “Chosen”, then called “JL – #000”, sold at 2.8 SOL as 1:1 on the primary market. Sold on the secondary market for 500 SOL, at the time he was priced at $45,000. First sold in March of this year.
now, @SOLMills_ on Twitter wrote a thread We discovered that Lê was selling his work as physical prints on a platform called InPrint.
In summary, John Lê retained the rights and IP to the original image. The buyer has no IP assigned to him, so officially he has the legal right to make copies in various formats, but not the right to make more of his NFTs of the exact image . “It will come down to a legal definition of ‘unique’ as to whether or not there was false advertising in the original sale and whether the buyer suffered a loss as a result of this false advertising,” Mills said. The downside of creating a new version is that the original 1:1 piece may depreciate in value. This may discourage clients from purchasing work from the artist in the future.
Mills said it was up to the free market to decide whether John’s actions were unethical.
